On Tuesday, February 24, the Tahoe Basin Design Review Committee will review the latest 39° North proposal.

At first glance, this may sound like a discussion about architecture — materials, façade details, and site layout.

But the meeting carries broader implications.

The Tahoe Basin Area Plan establishes building-length standards in the Kings Beach Town Center. Depending on housing integration and specific design criteria, building length may range from 200 feet, to 250 feet for buildings with integrated deed-restricted housing, and in limited circumstances up to 500 feet for qualifying mixed-use projects.

The current proposal includes a hotel building approximately 445 feet long, and a variance from the adopted building-length standard is being requested.

How the Committee evaluates that request — and which code pathway applies — matters.

Projects found consistent with adopted Area Plan standards typically proceed under a “TBAP Conformity” pathway, relying on the environmental analysis completed in the 2017 TBAP EIR.

If the Committee determines that the proposal satisfies the applicable standards, the project may continue under that conformity framework.

If relief from an adopted standard is granted through variance, the findings should explain how the project remains consistent with the Area Plan and within the development envelope evaluated in 2017.

This meeting does not finalize the project.

But it will clarify how the building-length standards are being interpreted — and how the next stage of environmental review proceeds.
